AIHS Terms and Conditions 

These terms and conditions apply to your:  

  •  application for membership with,
  • enrolment in a learning course held by; and/or
  • attendance at an event held by, 

 

the Australian Institute of Health and Safety (AIHS, we, us, our). It is your responsibility to review these terms and conditions prior to application or registration.  

By signing up for an event, educational or learning course or making an application for membership, you are agreeing to these terms and conditions. We reserve the right to amend these terms and conditions at any time and will provide the most recent version on our website.

If any provision of these terms and conditions is deemed invalid or unenforceable, all or part of that provision will be severed from the terms and conditions and will not affect the enforceability of the remaining provisions of the terms and conditions. These terms and conditions are governed by the laws of Victoria, Australia.

Privacy Notice

AIHS is concerned with the protection of your privacy. AIHS collects and stores your personal information in accordance with the privacy principles contained in the Privacy Act 1988 (Cth)(Privacy Act), as amended, for the purposes of providing membership services, education and training programs, and to manage our relationship with you. You consent to us collecting, holding, using, and disclosing your information outlined  the AIHS Privacy Policy.

 

EVENTS, LEARNING & PROFESSIONAL DEVELOPMENT

Payment: Payment in full is required 7 days from the date of registration, or one week prior to the commencement date of the event or course, whichever occurs first. If registering within 1 week of the event or course, payment is required immediately.  Anyone that has not completed payment will not be on the registration list and will not be admitted to the course/event or receive their link to the online platform.

Early Bird Registration Payment for events and courses: Must be finalised prior to the end of the early bird period or standard registration fees will apply. 

Invoices: When you complete your registration, you can pay immediately or request an invoice. Payment receipts can be accessed via your portal on the AIHS website
Please note:  AIHS’s invoice payment terms for events and courses are 7 days from date of issue or one week prior to the close of enrolment/registration, whichever is earlier.   

Costs incurred by AIHS in processing fees: All external costs incurred by AIHS in the processing of fees will be charged back to you. Such costs include, but are not limited to, related bank charges.

The following terms and conditions apply specifically to our courses and events

Health & Safety: You must agree to comply with the required health and safety processes and protocols in place at the event or forum where it is conducted (where not conducted online). You must not attend in-person if you have symptoms of any illness.

Behaviour: You are expected to behave in a professional and appropriate manner when participating in an AIHS event/course. AIHS reserves the right to prohibit entry of any person to an AIHS event or eject any person from a course or event based on behaviour deemed inappropriate by AIHS staff and/or its agents and others working under its authority. You acknowledge that cameras, audio, and video recorders may not be permitted at certain venues or events and must not be used to record online courses without permission.  

Canvassing: is strictly prohibited at AIHS events/courses. Promotional materials may not be distributed at the venue or online classroom except by approved sponsors. If you violate this policy, you will be asked to leave and AIHS members may have their membership revoked.  

Registration Discounts

Most of AIHS’s major events offer a discounted member rate(s), while some also offer group rates if multiple delegates register from the same organisation. Check each event registration page for available options.  

Any promotional offers are exclusive and are non-transferable. Delegates are entitled to one discount per registration.  

Registration Notice

AIHS member registration rates are not transferable to non-AIHS Members. By selecting a member registration rate, you represent that you are a current financial member of AIHS, and that the registration is made in the AIHS member’s name only. A breach of this may result in a cancellation of the product/service and/or AIHS membership.

Please note: Your registration for an event/course is not finalised until payment is received. If you do not receive a confirmation email within 24 hours, please email [email protected] to confirm that your registration has been received. Where places are limited in an event or course, they will be allocated on a strictly ‘first in’ payment basis. In the event that no space is available, you will be notified immediately and will not be charged.  

Substitutions: Should you be unable to attend, you may send a substitute in your place. AIHS must be notified of all substitutions prior to the commencement of the event/course. Refer to ‘General’ above in relation to non-member and member registration rates. By providing a substitute, you are confirming that they have read and agree to our terms and conditions.

Sharing registrations: One registration may not be used or shared by several individuals. 

Promotional offers and discounted registrations: Any promotional offers are exclusive and are non-transferable. Delegates are entitled to one discount per person. 

Special dietary/physical requirements: Special dietary/physical requirements will be catered for if requested before 14 days prior to the event. Please indicate any special requirements in your AIHS profile or contact  [email protected] with your specifications. Special dietary requests on the day cannot be guaranteed.

Cancellation by you

If your cancellation (for an in-person event/course) is in relation to illness or covid-19 symptoms, a credit will be provided for a future AIHS course/event. This credit expires 12 months after credit issued. If someone cannot attend due to illness, a medical certificate must be provided to receive the credit.

If you cannot attend an event due to extenuating circumstances and a substitute is not a viable option for you, please contact [email protected] with supporting documentation for review as to your eligibility for a credit.

Cancellations must be received in writing 7 days prior to the event or course date. No refunds will be given after the 7 days unless required under applicable consumer law. Refer to ‘Registration Notice’ above in relation to Substitutions.

National Conference Cancellations must be received in writing 60 days prior to the event. An administration fee of $150 will apply for all cancellations made before this date and no refunds will be given after this date.

Cancellation by us

Sometimes our courses/events are cancelled, varied, rescheduled, or postponed due to Force Majeure, situations which affect the facilitators/speaker, or other causes.

In these terms and conditions, a “Force Majeure Event” means any of the following (whether or not foreseeable or anticipated): acts of God, terrorism, war, civil unrest, strike or labour dispute, lack of transportation, breakdown, labour or material shortage, blockade or embargo, supplier failure, epidemic or pandemic, government restriction or recommendation, legal requirement, extreme weather, earthquake, drought, fire, flood, explosion, natural disaster, and/or any other event, cause or circumstance that is beyond our reasonable control.  

We are not responsible for airline tickets, hotel costs, other tickets or payments, or any similar fee penalties or related/unrelated losses, costs and/or expenses the registrant may incur or has incurred as a result of any cancellations or changes.  

Notification: We will use reasonable endeavours to notify registrants of a cancellation, variation, rescheduling, or postponement by sending an email to the address provided to us by the registrant and placing a notification on the relevant AIHS webpage.  

Sole remedy: To the extent permitted by law, any refund issued will be your sole remedy for a postponement or cancellation of an event/course, and AIHS will have no further liability to you in respect of any cancellation, variation, rescheduling or postponement for any reason.   

Limitation of Liability

To the extent permitted by law, we exclude all conditions and warranties relating to your registration for an AIHS event or course. Where AIHS’s liability cannot be excluded, such as in relation to the Consumer Guarantees under the Australian Consumer Law or other prescribed terms under legislation, to the extent permitted by law, our liability for breach is limited to the face value of the ticket purchased by you, plus any relevant booking and delivery fees.

You agree that AIHS will not be able to perform its obligations under these terms and conditions and in relation to the programmes to the extent such performance is affected by a Force Majeure Event. To the extent permitted by law we exclude all liability for consequential loss, which includes any indirect loss, loss of profit, loss of data or loss of reputation.   

Program

The program is confirmed at the date of publication. AIHS reserves the right to make changes to the program as circumstances dictate. Every effort will be made to ensure a program of equivalent standard. 

Should the revised program no longer meet the attendee’s expectations or requirements and they choose to cancel their registration the above “Cancellation by you” clauses will apply.  

Image release

In registering for AIHS events and conferences, delegates grant permission to AIHS, its agents and others working under its authority, to take and to have full and free use of video/photographs containing their image/ likeness. It is understood these images may be used for promotional, news, online/ multimedia, research and/or educational purposes by and for AIHS.

Attendees agree that they are not entitled to remuneration, residuals, royalties or any other payment from AIHS in respect of their image/likeness or its use. Attendees release, discharge, and hold harmless, AIHS and its agents from any and all claims, demands or causes of actions that they may hereafter have by reason of anything contained in the photographs or video.

Should you not agree to the above image release, you must advise AIHS via email on [email protected]  

Intellectual property

Some speakers may agree to share their content or recordings (where available) with only those registered or with AIHS members. This content is not intended for wider distribution – sharing, broadcasting and/or copying of this content is not permitted according to Australia’s intellectual property laws. Please be respectful of these speakers’ intellectual property so that we can continue to offer similar content in the future.  

 

MEMBERSHIP

Membership fees: Individual annual membership fees are due in full on joining AIHS or on anniversary of joining.  A reminder email will be sent to the email address on file prior to the renewal date. Membership fees are non-refundable and payable in full.  

A membership does not entitle you to a refund for previous events registered for and attended at the non-member rate.

Failure to pay membership fees at renewal:  Memberships not paid by the renewal date will fall into a ‘grace’ period for three months from the renewal date. Renewal within the ‘grace’ period will be backdated to the renewal date and the membership status will be made ‘current. Failure to renew before or during the ‘grace’ period will lead to membership expiration and you will cease to be an AIHS member.

Membership benefits will be cancelled upon membership expiration. If your membership expires, you must not use any AIHS professional designation after your name or otherwise claim to be a member of the AIHS.  Payment of membership after the expiration date will be treated as a new membership.

Invoices: When you complete your membership application form and choose to ‘pay later’, this becomes a tax invoice in compliance with ATO requirements. This can be used to make payment and you can keep this on file for your tax records.

CPD – Continuing Professional Development

Requirement for certification: To maintain your Certification status as ‘current’ you are required to complete a range of Professional Development activities to accrue an annual amount of 20 hours.  You can refer to the  CPD Points Guide for help with which activities accrue CPD hours.

For an event or learning course that is run by the AIHS, CPD hours will be displayed on the event description page.  When AIHS members register and attend the event or course, the relevant CPD hours will display on your AIHS Member Profile.

For any external events that are eligible for CPD, it is the responsibility of AIHS members to update their own CPD record on their AIHS Member Profile. AIHS members who have registered for an event but are unable to attend must notifying AIHS of non-attendance by emailing [email protected]

The following terms and conditions apply specifically to AIHS membership products and services.

Eligibility: Eligibility for AIHS membership is set out in Section 8 of the AIHS By-Laws.  

AIHS reserves the right to review your application and determine the acceptance or rejection of your application in accordance with the criteria for these eligibility requirements and according to its reasonable discretion. If accepted, your AIHS membership is valid for a period of 12 months unless otherwise stated.  

AIHS constitution, code of ethics and by-laws: Upon applying to become a member of AIHS, you agree to the AIHS constitution, the code of ethics and professional conduct, and all by-laws, notices, and directives of AIHS.  

Cancellation/refund policy: Subject to any rights you may have under law, AIHS can only provide a refund of membership fees in limited circumstances.

Transfer of membership: AIHS memberships are individual and non-transferable.

Upgrading membership: You may apply to upgrade your AIHS membership confirming you have met the eligibility requirements.  The associated fee for the membership at the upgraded level will be payable.
